Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the Pocketed website and application operated by Pocketed (“we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

Pocketed is an income management tool that helps freelancers and independent contractors split irregular income across predefined buckets (e.g. taxes, savings, spending). The Service is provided as a web application accessible at getpocketed.com.

2. Not Financial, Tax, or Legal Advice

Pocketed is not a tax advisor, accountant, financial advisor, or legal advisor. All calculations, estimates, and suggestions provided by the Service are for informational and planning purposes only. They do not constitute financial advice and should not be relied upon as a substitute for advice from a qualified professional.

Tax obligations vary by jurisdiction, income type, and individual circumstances. You are solely responsible for verifying the accuracy of any calculations and for filing your own taxes correctly. Pocketed accepts no liability for tax underpayments, penalties, or any financial loss arising from your use of the Service.

3. User Responsibilities

By using the Service, you agree to:

  • Provide accurate and complete information when creating your account and entering income data.
  • Keep your account credentials secure and notify us immediately of any unauthorised access.
  • Use the Service only for lawful purposes and in accordance with these Terms.
  • Not attempt to reverse-engineer, scrape, or otherwise misuse the Service.
  • Remain solely responsible for all tax filings, payments, and compliance with applicable laws.

4. Account Registration

You must be at least 16 years old to create an account. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

5. Subscription and Payment

Pocketed offers a free tier and a paid Pro subscription. Pro subscriptions are billed monthly or annually through Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis.

  • Cancellation: You may cancel your subscription at any time from the Settings page. Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until the period ends.
  • Refunds: We do not offer refunds for partial billing periods. If you believe you have been charged in error, contact support@getpocketed.com within 14 days.
  • Price changes: We will give you at least 30 days notice before changing subscription prices. Continued use after the notice period constitutes acceptance of the new price.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Pocketed. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

You retain ownership of all data you enter into the Service (income entries, client names, etc.). By using the Service, you grant us a limited licence to store and process that data solely to provide the Service to you.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Pocketed and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:

  • Your use of or inability to use the Service
  • Any errors or inaccuracies in calculations or estimates
  • Unauthorised access to or alteration of your data
  • Any tax underpayment, penalty, or financial loss

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Service Availability

We do not guarantee that the Service will be available at all times or free from errors. We may suspend or discontinue the Service, or any part of it, at any time without notice for maintenance, security, or other operational reasons. We are not liable for any downtime or interruption.

10. Termination

By you: You may close your account at any time from the Settings page. Upon account deletion, all your data will be permanently removed within 30 days.

By us: We reserve the right to suspend or terminate your account immediately if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent activity, or used the Service in a way that could harm other users or the integrity of the platform. In such cases, no refund will be issued.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new “Last updated” date, and where appropriate by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation before any formal legal proceedings.
